Terms of use

Scope

  • These terms of use ("the Terms of Use") shall be applied to the use of remote control service called "MobiConnect" ("this service") for smartphones, which is provided on the Internet by Inventit Inc. ("Inventit™").
  • The user of this service ("the user") may use this service in accordance with the Terms of Use.
  • In addition to the Terms of Use, provisions separately stipulated within this service (including Help and Notes) will constitute a part of the Terms of Use.

Login ID and Password

  • Each user is required to obtain corporate ID, user ID, and password.
  • Inventit™ will issue the corporate ID, user ID, and password for starting the use of this service to the person in charge within the user organization. The user can use this service and issue an user ID and password for its administrator(s).
  • The user shall be responsible for the use and management of these IDs and passwords, and Inventit™ shall not be responsible for damages caused by insufficient management by the user, incorrect use, use by a third party, or illegal login, etc.
  • It is prohibited to transfer or lend the corporate ID, user ID, or password to any third party other than the intended user.

Prohibited Matters

  • The followings are prohibited for use of this service. If Inventit™ determines that a user falls under the prohibited matters, Inventit™ may terminate services for said user, delete the user, or permanently terminate the use of this service by the user without any prior notice.
    • Action to attempt a false registration of user information.
    • Action by a user that violates any of the articles in the Terms of Use.
    • Special access other than by the use of web browser within the normal range.
    • Action to place load onto the system by issuing a large amount of requests to this service.
    • Action to use a corporate ID, user ID, and password without permission from the original user.
    • Action equivalent to reverse engineering such as illegal access and cracking.
    • Action that infringes laws and regulations.
    • Action that relates to crime.
    • Action that infringes a patent right or intellectual property right of Inventit™ or any other third party.
    • Action against public order and morals.
    • Action that is regarded as socially inappropriate.
    • Other actions that Inventit™ determines to be inappropriate.

Protection of Information

  • Inventit™™ will pay the most attention to protection of information registered via this service. The personal information shall be handled properly in accordance with applicable laws and regulations.

Responsibility of User

  • If any problem arises among users or between a user and a third party, the user(s) must resolve the problem on its own responsibility and at its expense, and Inventit™ shall not bear any responsibility for it.
  • The user shall be responsible for management of information it has registered by itself using this service, and Inventit™ shall not bear any responsibility for it.
  • The user shall use this service on its own responsibility and shall bear the entire responsibility for all actions performed using this service and the results obtained through this service.

Description of Service

  • This service enables users to remotely control information terminal devices and software running on such devices by using the server system provided by Inventit™ over the Internet and client applications for information terminal devices including smartphones.
  • When controlling the information terminal devices including smartphones and the software running on them, this service uses external SMS (short message service) to send SMS to the information terminal devices that provide some of their functions by properly receiving the SMS. Some mobile phone operators and information terminal devices may not be supported due to certain reasons associated with the external SMS used by this service. In such cases, some functions of this service shall be provided by performing periodical communication from the information terminal devices to the Internet server system that provides this service, without using the above mentioned SMS. This service may not be available when using information terminal devices, phone-line services of mobile phone operators, or communication environment that cannot receive SMS properly or cannot perform proper periodical communication with the server system.
  • Due to the technical nature of SMS, there may be some cases where SMS is not sent to information terminal devices including smartphones, SMS cannot be received on the information terminal devices, or communication cannot be established with the server system; however, Inventit™ shall not be responsible for damages caused in such cases. And the fee for this service shall not be refunded for unavailability of this service due to such reasons.
  • This service allows retrieving information such as terminal status, usage situation, and location data from information terminal devices including smartphones. Such retrieved information shall be used only for providing and operating this service and shall be handled in accordance with the separately prescribed Privacy Policy.
  • This service will become available on the date notified by Inventit™ once the payment of usage fee is confirmed.

Change, Suspension, and Discontinuation of Service

  • Inventit™ may reserve the right to change all or some contents of this service. When changing the contents of this service, an advance notice shall be posted on the portal site of this service (http://mobi-connect.net).
  • Inventit™ reserves the right to suspend or discontinue all or some contents of this service. When suspending or discontinuing this service, an advance notice shall be posted on the portal site of this service (http://mobi-connect.net); however, this may not apply if it is urgent and unavoidable.

Temporary Interruption of Service

  • If any one of the following situations arise, Inventit™ may temporarily interrupt this service without prior notice to users. Inventit™ shall not be responsible for damages caused by the interruption of this service. And the service fee shall not be refunded for the interruption of this service.
    • When urgently carrying out the maintenance of this service.
    • When it becomes impossible to provide this service due to fire or power outage, etc.
    • When it becomes impossible to provide this service due to natural disasters such as earthquake, eruption, or flood.
    • When it becomes impossible to provide this service due to war, upheaval, or riot, etc.
    • When it becomes impossible to provide this service due to a failure of external network that is out of our control.
    • When it becomes impossible to provide this service due to a failure of external service used by Inventit™.
    • Other cases where Inventit™ determines that a temporary interruption of this service is required due to an operational or technological reason.
    • Inventit™ may temporarily interrupt this service after providing an advance notice to users, for the purposes of maintenance, inspection, or repair. Inventit™ shall not be responsible for damages caused by the interruption of this service. And the service fee shall not be refunded for the interruption of this service.

Usage Fee

  • When using this service, the user shall be billed the fee that is separately prescribed by Inventit™. In addition, the user shall bear all the expenses associated with communication and connection such as line usage fee for information terminal devices and equipment costs.
  • Payment of usage fees for this service shall be made in accordance with the payment method that is separately specified by Inventit™. If multiple payment methods are provided, the user may select a payment method to pay the fee described in the previous item. When the user requests to change the payment method, the change shall take effect from the date determined by Inventit™.
  • Unless otherwise specified in the Terms of Use, Inventit™ shall not refund any usage fee that has already been paid, including midterm cancellation during usage period, once subscription procedures for this service have been completed.
  • If the payment of usage fee cannot be confirmed by the due date specified by Inventit™, Inventit™ reserves the right to suspend the use of this service by that user, change the password of that user, or disqualify that user from the use of this service without prior notice to or prior consent of the user.
  • Unless the user provides Inventit™ with a prior notice about cancellation of this service, the service is automatically continued, and Inventit™ shall bill the user for the usage fee prior to expiry of the usage period.
  • Inventit™ shall reserve the right to change the fee structure of this service. A prior notice shall be provided to users before changing the usage fee.

Cancellation of Service

  • When the user wishes to cancel this service, the user shall be required to follow the cancellation procedures separately specified by Inventit™, and this service shall be cancelled upon the completion of such procedures.
  • Upon completion of cancellation procedures for this service, the user will lose all the corporate IDs, user IDs, password rights and privileges necessary for using this service.

Change in the Terms of Use

  • Inventit™ may change the Terms of Use without prior notice to users. When the Terms of Use have been changed, it shall come into effect upon posting on the portal site of this service (http://mobi-connect.net), and the users shall be deemed to have agreed with the changed Terms of Use.

Disclaimer

  • Inventit™ shall not be responsible for any damage caused by the user to any other user or third party through use of this service.
  • Inventit™ shall not be responsible for damages caused by addition or change to the contents of this service or interruption or termination of this service. The same shall apply to the cases where browser's display speed or operating speed is decreased, or any failures including data loss due to unexpected factors such as excessive access in the Internet environment.
  • In the event that follows, Inventit™ reserves the right to browse the information registered by users and to perform required operation or processing by logging in user's management screen or accessing the user's database. Inventit™ shall not be responsible for associated damages that may be caused to the user.
    • When Inventit™ registers required information on behalf of the user.
    • When Inventit™ needs to identify and resolve a technical failure or cause of trouble with this service.
    • When a statutory request is made by a public agency such as court or police.
    • When an action that infringes or may infringe the Terms of Use has been performed and Inventit™ determines that the registered information must be confirmed.
    • When an imminent danger to life, body, or property exists and Inventit™ determines that there is an urgent need.
    • Other cases where Inventit™ determines that a need has arisen for the proper operation of this service.
  • Inventit™ shall not be responsible for actions occurred through the use of this service by users or for any problems occurred as a result, including but not limited to information leakage.
  • Inventit™ shall not be responsible for any problems or damages that are potentially caused by the inability to remotely control information terminal devices due to the deletion or uninstallation of client applications installed in the users' information terminal devices including smartphones during the use of this service or associated with service cancellation.
  • Inventit™ shall not bear any responsibility for any problems or damages caused as a result of the inability to remotely control information terminal devices including smartphones due to certain reasons including communication failure and malfunction of this service.

Governing Law

  • The Terms of Use shall comply with the domestic law of Japan.

Court of Jurisdiction

  • Regarding any disputes related to the Terms of Use, the municipal court or summary court that shall be the dedicated and agreed court that has jurisdiction over our headquarters or branch offices.

Dominant Language

  • The official version of the Terms of Use shall be the Japanese version and the Japanese version shall take precedence if it conflicts with any other version of different languages.
